These Terms of Service (hereinafter referred to as the “Terms”) constitute a legally binding agreement between you (an individual or the entity you represent) and Glossier, Inc. and its affiliates (hereinafter referred to as “Glossier,” “we,” or “us”). These Terms govern your access to and use of our official website (glossier.com), mobile applications, social media interactive pages, physical retail stores, and all related products, services, and features provided by us.

Please read these Terms carefully before accessing, browsing, or using our services, or registering an account and purchasing products on our platform. By accessing or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy and Return & Exchange Policy. Glossier shall not be liable for any loss or damage arising from your failure to safeguard your account information.

2. Purchases, Products, and Pricing

  • Product Availability and Descriptions: We strive to display product colors, ingredients, and effects as accurately as possible on our website. However, due to monitor resolutions, lighting conditions, and individual skin differences, actual product appearance or performance may vary. All product supplies are subject to availability, and we reserve the right to limit sales quantities of any product, modify product specifications, or discontinue any product at any time without prior notice.
  • Pricing Policy: All prices displayed on the website are quoted in US Dollars (or the local currency indicated at checkout) and, unless explicitly stated otherwise, do not include applicable taxes and shipping fees. We reserve the right to change product prices at any time, provided that any price changes will not affect orders for which you have already completed payment and received an order confirmation email.
  • Order Acceptance and Cancellation: Orders placed online by you merely constitute an offer to purchase products. Our order confirmation email does not signify our final acceptance of your order, but rather confirms that we have received your order. We reserve the right to refuse or cancel any order at any time for reasons including, but not limited to: insufficient product inventory, pricing errors, suspected fraud, or violation of these Terms. If your order is canceled, we will issue a full refund via your original payment method.

3. Intellectual Property and Content Ownership

  • Glossier Assets: All content included on this website and services, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, software code, and the “Glossier” trademark and brand identity (collectively, “Glossier Content”), is the property of Glossier or its licensors and is strictly protected by US and international copyright, trademark, patent, and intellectual property laws.
  • License to Use: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our services and view Glossier Content solely for personal, non-commercial purposes. You may not copy, modify, distribute, sell, rent, transfer, publicly display, reverse engineer, or exploit any portion of the Glossier Content without the prior explicit written permission of Glossier.
  • User-Generated Content: When you post, upload, submit, or share text, photos, videos, reviews, or other content on our platform, social media, or review sections (hereinafter referred to as “User Content”), you grant Glossier a worldwide, perpetual, royalty-free, transferable, sublicensable right to use, copy, modify, adapt, publish, translate, create derivative works from, and distribute such content in any media platform for marketing, promotional, and commercial operation purposes. You represent and warrant that you own all rights to such User Content and that it does not infringe upon the legitimate rights and interests of any third party.

4. User Conduct Guidelines

When using Glossier services, you agree to strictly comply with the following code of conduct. You shall not engage in any of the following activities:

  1. Violate any applicable local, state, national, or international laws or regulations.
  2. Infringe, misappropriate, or violate the intellectual property rights, privacy rights, rights of publicity, or other legal rights of Glossier or any third party.

  5. Engage in any automated data collection activities (such as web scrapers, spiders, or robots) to collect data or user information from our platform.
  6. Post any false, misleading, abusive, defamatory, obscene, harassing, or hate-speech-related content.
  7. Use our products or services for any unauthorized commercial purposes, resale, or profit-making.

5. Disclaimers and Limitation of Liability

  • “As Is” Basis: Our services and all products are provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Glossier does not guarantee that the services will be uninterrupted, secure, error-free, timely, or completely meet your expectations.
  • Limitation of Liability: To the maximum extent permitted by law, Glossier and its directors, officers, employees, agents, and partners shall not be liable for any indirect, incidental, special, punitive, or consequential damages, including but not limited to loss of profits, loss of goodwill, loss of data, or business interruption, whether based on contract, tort, negligence, strict liability, or any other legal theory, even if Glossier has been advised of the possibility of such damages. Glossier’s total cumulative liability arising out of any order or service shall in no event exceed the total amount actually paid by you to us for the specific product or service giving rise to the claim.

6. Indemnification

You agree to defend, indemnify, and hold harmless Glossier and its affiliates, officers, directors, employees, and agents from and against any third-party claims, demands, losses, liabilities, damages, or expenses (including reasonable attorneys’ fees) arising out of or related to:

7. Dispute Resolution and Governing Law

  • Governing Law: These Terms and any dispute arising out of or in connection with these Terms or our services shall be governed by and construed in accordance with the laws of the State of New York, USA, without regard to its conflict of law principles.
  • Informal Negotiation: If any dispute arises between you and Glossier, both parties shall first attempt in good faith to resolve the dispute informally within 30 days of receiving written notice.
  • Arbitration Agreement: If the dispute cannot be resolved informally, any controversy, dispute, or claim arising out of or relating to these Terms or services shall be submitted to a competent arbitration institution for final and binding arbitration, rather than litigated in court. You agree to waive any right to a jury trial or to participate in a class action lawsuit.

8. Amendments and Termination

  • Right to Modify: We reserve the right at our sole discretion to modify, update, or replace any part of these Terms at any time. Modified terms will become effective immediately upon being posted on the official website. It is your responsibility to check these Terms periodically for changes. Your continued use of our services following the posting of any modifications constitutes your unconditional acceptance of the revised terms.
  • Termination: We have the right at any time, for any reason (including suspected violation of these Terms), to suspend or terminate your access to your account and services without prior notice obligation. Upon termination, provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, and limitations of liability) shall continue in full force and effect.
